Amend zoning plan
What is it?
A zoning plan states how the land in an area and the buildings on it may be used. If you want to use land or buildings in a different way than the zoning plan states, you can ask the municipality to amend the zoning plan. You can do this for an existing zoning plan or for a zoning plan that is not yet final.
Change zoning plan or apply for environmental permit
Although anyone can apply for a zoning change, it is most common for larger projects such as the construction of office buildings in a residential area. For smaller plans, apply for an environmental permit for contrary use.
How does it work?
By applying to the municipality for a zoning adjustment, you can change the rules for the use of land or buildings in an area. Anyone with an interest may request an adjustment. For example, if you live in the area.
What to do?
Modify existing zoning plan
You ask the municipality to amend the existing zoning plan. If the municipality agrees with you, the zoning plan can be modified.
You may mail the application to gemeentehuis@kerkrade.nl or submit it in writing to the Board of Mayor and Aldermen, Postbus 600, 6460 AP in Kerkrade.
Not yet final zoning plan update
A zoning plan that is not yet final is called a draft zoning plan.
- The municipality makes a draft zoning plan. This is announced in advance in a door-to-door newspaper and here on the website.
- View the draft zoning plan via Ruimtelijkeplannen.nl or at City Hall.
- You can give your opinion within 6 weeks after the draft zoning plan is announced.
- The municipality then adopts the zoning plan.
- If you still want the zoning plan amended, you can indicate this within 6 weeks after the municipality has adopted the plan. This is called filing an appeal and you do it at the Administrative Law Division of the Council of State.
What should I bring?
To make clear why you want to amend the zoning plan, provide the following documents to the municipality with your application:
- A description of your building plans.
- Construction drawings of the situation as it is now and of the new situation.
- Situation drawings and/or a floor plan.

Note! Has the zoning plan been changed and do you want to build after that? Then you still need a building permit. You can apply for this via Omgevingsloket.nl.
