What do I need?

How long does it take?

Are you applying for debt assistance from the municipality? Then you must have an initial interview within 4 weeks. In urgent cases you must have an interview within 3 working days. For example, if you risk being evicted from your home, your gas, water and electricity are cut off or your health insurance is cancelled.

Usually the debt counselor comes up with a solution that will pay off your debts in 3 years. Sometimes this can be 5 years.

Additional information

Debt relief is also known as "debt restructuring. Debt restructuring is a way to get rid of your debts. This can be through voluntary debt restructuring or through legal debt restructuring.

Voluntary debt restructuring

Can you no longer pay your debts yourself? Then ask for help from the municipality or the Municipal Credit Bank, for example. A debt relief worker will then make a proposal to your creditors as to how you can pay off your debts. The creditors may agree, but this is not obligatory.

Only if you are unable to pay your debts through the voluntary way can you try to pay off your debts through the courts. Statutory debt restructuring is also called the "Wsnp. For this you need a statement stating that voluntary debt restructuring is not successful. The municipality can issue this statement and help you start the Wsnp process.

Credit from the credit bank

Your municipality can also help you by "taking over" your debts from your creditors. This is called a rehabilitation loan. Instead of paying to all your creditors, you then pay a number of years (usually 3) to your municipality or the municipal credit bank.

Obligations

The creditors or the agency giving you credit may have requirements for help. You must follow these requirements:

  • Budget education: You will receive information and advice on how to make ends meet on your income independently.
  • Budget counseling: You will receive counseling that teaches you how to manage money.
  • Budget management: An agency manages your income. They pay your fixed expenses and you receive only household money. Budget management often lasts the entire period you are paying off.
  • Duty to provide information: You must provide any information that could affect you. For example, if you get more income, move or lose your job.
  • Duty to cooperate: You must provide all the cooperation necessary for your debt relief process.
  • No new debts: During debt relief, you may not incur new debts.

Legal debt restructuring

Are creditors not cooperating with voluntary debt restructuring? Then you can ask the court for legal debt restructuring. This is a Wsnp trajectory. For this you need a statement stating that voluntary debt restructuring is not fortunate. The municipality can issue this statement and help you start the Wsnp trajectory.

Does the judge agree? Then the creditors must cooperate. The judge appoints a trustee to manage your finances. Within 3 to 5 years you pay off as many debts as possible. Then the judge decides whether you can continue without debts ('clean slate').

Legal debt settlement allows you to pay off all your debts except:

  • debts from student loans
  • fines for crimes
  • damages
