Law on Management and Supervision of Legal Persons (WBTR).

From July 1, 2021, all associations and foundations must comply with the new Law on Management and Supervision of Legal Persons (WBTR).

The law applies to all boards and is intended to improve the governance and supervision of associations and foundations. To do this, it is important that you regulate a number of matters properly. One of these matters is decision-making within the association or foundation. Because if something goes wrong, you as a board member or supervisor can be held personally liable.

What does the WBTR actually entail?

The WBTR Act deals with:
- Position and duties of board members and supervisors
- Liability of board members and supervisors
- Financial policy and approval of expenditures
- Rules on conflicts of interest
- Procedures for major expenditures or investments

It is important that your association or foundation comply with the WBTR. Especially since after July 1, there will be joint and several personal liability if something goes wrong. This law also applies to very small associations and foundations. This will prevent hassles within the foundation, such as financial problems, self-enrichment of directors, fraud and theft. So it is important to be well prepared for the new WBTR.
