Compulsory Mental Health Care Act (Wvggz).
People may be at risk of harming themselves or others because of a psychiatric condition. Sometimes mandatory mental health care is then necessary. On Jan. 1, 2020, the Compulsory Mental Health Care Act (Wvggz) went into effect. This law replaces the former law on special admission to psychiatric hospitals (Wet BOPZ). The municipality constitutes an additional access to compulsory Health after the introduction of the Wvggz. Access to compulsory Health for professionals in the mental health system and the Public Prosecution Service also remains.
More opportunities for treatment
The new law makes better provision for the individual and his family to have a say in treatment and subsequent help. Under the old law, compulsory Health was always compulsory admission. Under the Wvggz, compulsory treatment can also take place at home or on an outpatient basis. Mandatory Health is still subject to strict Requirements. So the new Wvggz does not make it easier to give someone compulsory Health or to admit them. However, there are more possibilities of compulsory Health and it can be provided more in someone's own environment and network.
Last resort
Mandatory mental health care is a last resort and is used only when no other solution is really possible. Of course, it is preferable to provide appropriate help and Health earlier and on a voluntary basis to residents who need it. In the municipality we cooperate with many parties for this purpose. For example, with social work, the housing associations, care organizations, volunteers and many more. This includes, for example, assistance with independent living, help with finances or dealing with addiction. However, sometimes things go wrong and then the Wvggz can offer a solution.
Notification of psychological help (Wvggz)
The new law states that anyone who is concerned that someone is a danger to themselves or others can report it to the municipality. This report must be made to the municipality where the person with mental health problems lives.
In fact, family, loved ones or neighbors are often the first to notice that someone is not doing well. It is important to report this before the situation becomes serious. The person involved can then get help as soon as possible.

Please note that compulsory Health is invasive and is only used in serious situations where someone does not want to cooperate with Health that is urgently needed. Thus, the Wvggz does not provide a solution for everyone.
