The Omgevingswet deals with the physical environment. This is the space in which we live, work and relax.
This new law merges 26 laws on building, housing, traffic, heritage, environment, nature and water. This allows you to see at once the rules and regulations of the municipality, the water board, the province and the state.
The law applies to all residents, organizations and businesses in the Netherlands as of Jan. 1, 2024.
The Omgevingswet summarizes various laws and regulations
Until now, the Netherlands has had many different laws and regulations regarding the living environment. These laws are not only difficult, but they also sometimes contradict each other.
Moreover, all these loose laws and regulations ensure that new developments often take unnecessarily long. Or that new and sustainable ideas cannot be implemented as easily. Because hardly anyone can find their way around anymore. Therefore, as of January 1, we summarize all these rules and laws in an easier way in the Omgevingswet:
- From 26 laws to 1 law
- From 60 Orders in Council to 4 Orders in Council
- From 75 ministry regulations to 1 Environment Regulation.
The purpose of the Omgevingswet
The Omgevingswet strikes a good balance between using and protecting the environment. People know faster whether something is possible or not. And there is more room for local customization. The Omgevingswet Act also ensures better participation: citizens and entrepreneurs are more and better involved in what happens in their environment. The municipality asks them to help think about plans.
To achieve these goals, the municipality will use two new tools:
The Environmental Vision
The Environment Vision replaces the Structure Vision. The Environment Vision describes what our municipality should look like in the future. By 2027, the municipality of Kerkrade must have a single Environment Vision for the whole municipality.
The Environmental Plan
The Environment Plan will replace all current zoning plans. By 2032, the municipality of Kerkrade must have one Environment Plan for the entire municipality.
