Environment, permit or notification

What is it?

As a business owner, you must comply with environmental regulations. For certain activities that affect the environment, you must apply for an environmental permit or file a report.

Are you starting a new business or modifying or expanding an existing business? Then you can do a permit check via Omgevingsloket online. You will then see whether you need to apply for a permit or make a notification.

How does it work?

Environmental rules you must follow include the following:

  • processing of waste
  • noise level of your company
  • use of energy
  • pollution of water, soil and air

What to do?

First, see if you need to apply for a permit or file a notification. This depends on which category your company falls into. You can do this through Omgevingsloket online with eHerkenning. You can only do the application or notification online.

You can also use Activity Order Internet Module (AIM) to see if you need to apply for a permit or make a notification.

Permit application

Fill out the application form completely. Send the application form with the requested documents to the municipality. The municipality will send an acknowledgement of receipt of your application.

In the case of a complex application, the municipality first makes a draft decision on your application. Everyone can give his or her opinion (view) on this within 6 weeks. Do you disagree with the draft decision? Please explain why in your opinion.

You will automatically be notified whether you will receive the permit.

Report

Make the notification at least 4 weeks before you start your activities. The municipality will send you an acknowledgement of receipt of your notification. This confirmation of receipt does not automatically mean that you have met all the requirements. The municipality checks whether the notification is complete and sometimes asks you for additional information.

How long does it take?

Permit application (regular application)

Within 8 weeks, you will be notified whether you will receive the permit. This period can be extended by 6 weeks. Does the municipality not decide within the deadline? Then you will receive the permit automatically (by operation of law).

Do you disagree with the municipality's decision? Then you can object within 6 weeks.

Permit application (complex application)

Within 26 weeks, you will be notified whether you will receive the permit. This period can be extended by 6 weeks.

Do you disagree with the municipality's decision? Then you can file an appeal with the court within 6 weeks. This is only possible if you have also submitted an opinion on the draft decision.

Notification

4 weeks after your notification, you can begin your activities.

Pre-consultation

Do you want to prevent the municipality from not processing your application or denying you a permit? Then it is important to consult well with the municipality about your plans. This important stage in the procedure is called preliminary consultation. Therefore, contact the municipality as early as possible with your business plans.
