Participation law changes, more clarity and room for customization
The rules for welfare and job assistance are being changed. The government wants the Participation Act to be simpler and more humane. This means more room for customization and trust. Many changes will already take effect this fall, others will follow in early 2026.
What will change?
The new rules make it easier for residents to get help. Below are the most important changes:
- Young people sometimes do not have to look for work themselves for 4 weeks first. For example, if they need to integrate, have a disability or have just moved.
- Applying with DigiD or driver's license becomes easier.
- Quick application when re-entering: Have you previously received assistance and are eligible again? Then the application can be arranged faster.
- Gifts of up to €1,200 per year are now exempt. You don't have to declare this unless you receive more.
- Retroactive assistance is possible for up to 3 months if there are special circumstances.
- Debts are counted when assessing your assets. This can help when applying for assistance.
- Informal care does not count as work. If you care for someone, it does not affect your eligibility for assistance.
- Advance payments will be increased from 90% to 95% of the normal amount from January 2026.
- Cohabitation and assistance: Only if you were married or considered married within the past 2 years will it count when assessing your situation.
- Young people aged 18-21 will now receive regular assistance, without a separate supplement (starting in early 2026).
Why these changes?
The government wants the rules to be more in line with practice. Many municipalities already do some things, but that will now be laid down officially. Counselors will also get more room to look at what someone really needs.
