Installation of scaffolding, fence or materials
What is it?
A permit is required to place a scaffold, fence, fencing or materials on the public highway. The granted permit does not exempt you from claims and/or damages from third parties, which may result from using the granted permit.
How does it work?
This permit can be requested from the Municipality of Kerkrade using the appropriate digital application form. There are Requirements attached to the permit for placing a scaffold, fence, fencing or materials that everyone must comply with.
Requirements:
- The distance between scaffolding and front sidewalk must be at least 0.15 at all times;
- If the distance is less than 0.60m, a sign marked "Pedestrian crossing" should be placed at both ends of the jetty;
- Depending on the site situation, measures should be taken to ensure safe passage for disabled cars and people with strollers;
- Any damage to municipal property, as a result of the placement of the scaffolding and the work to be performed, will be repaired by the municipality, but at your expense;
- Both sides of the jetty, fence or fence and, if desired, the street side, must be lit from one-half hour after sunset until one-half hour after sunrise ( electric );
- The work performed on the façade of the parcel for which this permit is granted shall not cause danger or nuisance to the public;
- If felling work is carried out on the facade of the house, the scaffolding to be erected must be fully equipped with tarpaulins so that loosened rock ( concrete grout ) cannot cause damage to third parties or their property;
- The work must be performed according to the applicable ARBO Requirements as stipulated in the ARBO Act;
- Before proceeding with placement, please notify the municipality in advance and at least one week before the planned placement;
- The permit may be terminated at any time by the Board of Mayor and Aldermen;
- Enforcement of the Requirements the issued permit is done by the Department of Public Works i.c. the Enforcement Cluster. All instructions must be strictly followed. Failure to comply with these directions may result in revocation of the issued permit;
- If a permit has been cancelled or revoked, the scaffolding , fence or fencing must be removed within a period to be specified in the notice. If the scaffolding, fence or fencing is not removed, the Municipality of Kerkrade will have the scaffolding, fence or fencing removed, at your expense;
- No building materials or other objects may be placed around the scaffolding, fence or fencing without prior permission from the Municipality of Kerkrade. This should be done when applying for the permit by means of a clear situation sketch which indicates in writing which materials or objects will be stored at the requested location;
- The fire route and fire extinguishing points shall remain clear at all times. Instructions given by the fire department, police or duly authorized officials of the Municipality of Kerkrade shall be followed without delay;
- If the permitted period threatens to be exceeded due to the fact that the planned work will take longer than stated in the permit issued, the permit holder must immediately inform the official handling the permit of the Municipality of Kerkrade by telephone. Further arrangements will then be made by mutual agreement as to how the matter will be resolved;
- Should it appear that an event is taking place in the vicinity of the site during the application for the installation of the scaffolding and the proposed work, the Municipality of Kerkrade reserves the right to refuse the permit or, by mutual agreement, to postpone the proposed work until after the event.
What does it cost?
A fee is associated with the application. For the year 2023, this amount is set at euro €25.70.
