Remodeling and new construction area D'r Pool

On the site of the former sports complex with swimming pool D'r Pool, an entirely new attractive residential area will soon be created. Demolition of the existing buildings began in September 2023. On the vacant site, luxury residential apartments and town houses are then expected to be built in 2025 in an attractive green park-like residential environment.

Through a competition study, the plan by Martens Willems & Humblé architects was chosen as the winning design. This design formed the basis for the further development into an urban development plan in which all components such as buildings, greenery, roads, parking and other important matters were included.

On Kapellaan, a detached small-scale building with 9 park apartments is planned. On the north side of the plan area, parallel to Engerweg, an elongated apartment building with 29 apartments will be built. On the east side, 11 town houses will then be realized. An underground parking garage is provided for parking.

Through the apartment buildings and townhouses will be situated around a "courtyard. This will create a small park and a raised "terrace" above the parking garage.

The building plan will be realized by developer Arcus Zuid Projectontwikkeling BV. For more information about the building plan, please contact them. The Municipality of Kerkrade itself will have no role in the sale of the homes.

The backyards of these houses border on the backyards of the houses on Stationsstraat. An underground parking garage is provided for parking.

Procedure

Zoning procedure

A zoning plan determines what can be done with space in a municipality. A zoning plan states whether and how construction is allowed. There is a set process for creating zoning plans. You can influence them in various ways.

Mayor and aldermen are currently preparing the zoning plan. The Council ultimately adopts the zoning plan. Do you disagree with a zoning plan? Then after its adoption, you can file an appeal with the Administrative Law Division of the Council of State.

Draft zoning plan

Mayor and aldermen prepare a draft zoning plan. They consult with relevant administrative bodies such as the Province and the Water Board. During the preliminary phase, they also talk to local residents and other interested parties, and relevant comments, facts and interests are weighed up and destinations, rules and explanatory notes are drawn up.

For consideration

Subsequently, this draft zoning plan will be made available for inspection by the mayor and aldermen for six weeks. This public inspection is announced on the municipality's website, in the free local paper and in the electronic Municipal Gazette. Within the inspection period anyone can submit an opinion.

Views

Anyone can submit views on the draft decision within 6 weeks.

Mayor and aldermen review the submitted views. The zoning plan may also be adopted as amended. The mayor and aldermen submit the zoning plan to be adopted together with intended responses to the views to the city council for decision-making.

Adoption and publication  

The adoption of the zoning plan by the City Council is again announced through the municipality's website, in the door-to-door newspaper and the electronic Municipal Gazette.

Profession

If you do not agree with (parts of) the adopted zoning plan, you can submit a notice of appeal to the Administrative Law Division of the Council of State within the six-week appeal period. This is possible even if you have not previously submitted an opinion on the zoning plan.

Provisional provision

If you have an urgent interest, you can request a preliminary injunction from the Chairman of the Administrative Law Division of the Council of State.

Irrevocable zoning plan

If no appeal is filed during the public inspection period, the zoning plan is irrevocable from the day after the end of the appeal period. From then on, the zoning plan is in effect as a review framework for the development of the area.

If an appeal has been filed, the zoning plan enters into force on the day after the appeal period expires. The zoning plan will then only be irrevocable after the ruling of the Administrative Law Division of the Council of State. If a request for preliminary relief has also been filed, the zoning plan will not yet take effect.

Planning

The schedule of work is (based on the current state of affairs) as follows:    

  • demolition ready spring 2024; 
  • Completion of awarding construction land and site plan: spring/summer 2024;
  • completion of zoning process (without objection and appeal): spring/summer 2024;
  • preparation and application for environmental permit: through the end of 2024;
  • Issuance of environmental permit: early 2025;
  • intended start of construction: spring 2025;
  • intended completion of building plan: fall 2026.

Housing sales

Building plan development and preparations for the construction of the new homes will still take time.

Arcus South Project Development will begin to bring the building plan to the attention of interested parties and sell the homes through a broker in due course.

The municipality of Kerkrade itself will have no role in the sale of the properties.
