Permit check and pre-consultation

Als u een vergunning nodig heeft, kunt u die direct aanvragen via het Omgevingsloket. De totale doorlooptijd van een officiële vergunningsaanvragen sinds het ingaan van de Omgevingswet ingekort, echter voor sommige plannen is nog steeds goedkeuring van een provincie of onze gemeenteraad nodig. Dit betekent dat de informele procedure (vooroverleg) nog belangrijker wordt.

U doet er als initiatiefnemer goed aan om in een vroeg stadium contact te leggen met de gemeente, vooral als u een (ruimtelijk) plan heeft dat (veel) invloed heeft op de omgeving. Als gemeente helpen wij graag met vragen en initiatieven. Hieronder wordt nader ingegaan op de mogelijkheden die hiervoor zijn.

Vergunning checken

Als initiatiefnemer kunt u in het nieuwe Omgevingsloket een vergunningscheck doen. U controleert dan of u uw plannen mag uitvoeren of dat u daar een vergunning voor nodig heeft of melding van moet doen. Dit doet u door een aantal vragen te beantwoorden.

Mocht uit de vergunningcheck geen duidelijk uitsluitsel volgen of twijfelt u of uw plan past binnen het omgevingsplan (voorheen bestemmingsplan) dan kunt u een informatieverzoek doen via ons algemene mailadres: gemeentehuis@kerkrade.nl

Verken uw idee (principeaanvraag)

Heeft u een idee voor een project dat u wilt verkennen? Of heeft u een plan, maar wilt u eerst de mogelijkheden bespreken voor u het verder uitwerkt?

Het indienen van principeaanvragen raden wij in ieder geval dringend aan voor plannen waarvan u weet of vermoedt dat deze niet passen binnen het omgevingsplan (voorheen bestemmingsplan). Voorbeelden hiervan zijn het wijzigen van een functie (bijvoorbeeld van café naar wonen of andersom), het splitsen van woningen en/of het realiseren van grote aanbouwen of bebouwing buiten het bouwvlak of maximale bouwhoogte.

Een principeaanvraag is nog geen officiële vergunningaanvraag. Het is een voortraject waarin u hoort of uw plan uitgevoerd kan worden. De gemeente zal dan uw plan of idee toetsen, de mogelijkheden of onmogelijkheden aangeven of aangeven welke aanpassingen nodig zijn. Een principe-aanvraag kunt u aanvragen via onze website of via de optie “verken uw idee” in het Omgevingsloket.

Na het afronden van het principeverzoek kunt u (in geval van een positief resultaat) uw plan verder uitwerken en de noodzakelijke stukken voor een aanvraag omgevingsvergunning gereed maken.

Application in Principle

Within the municipality of Kerkrade we call this preliminary consultation an application in principle. You can apply for a request in principle via our website and the Environment Desk.

An application in principle is a draft permit application. You tell the municipality in general terms what you want to do. We then review your plan or idea and indicate the possibilities or impossibilities. Or we tell you which adjustments are necessary.

Intake table

For more complex initiatives, you as an initiator can use the Intake Table. These are initiatives for which, for example, the zoning plan must be changed, or for which we as a municipality must follow an extensive procedure to make the initiative possible. Think of the establishment or expansion of a company, or the construction of several houses.

At the Intake Table, several municipal employees discuss whether the initiative is feasible and desirable. This way you will quickly know whether it makes sense to develop your plan further.

The consultation at the Intake Table is an informal preliminary consultation. After agreement at the Intake Table, you submit the final permit application. Then your application will be formally reviewed.

Environment Table

Finally, for very large and complex initiatives, there is the Environment Table. At the Environmental Table you, as initiator, will enter into discussion with all of the municipality's key interlocutors such as the water board, the province, the state, the environmental service, the aesthetics committee, the safety region and the Public Health Service. Together you will review the feasibility and desirability of your plans. After this you will receive an advice with which you can prepare and submit the permit application.

Permit-free construction

Under the Omgevingswet , building can involve the technical construction activity and the environmental plan activity related to structures.

The State has exempted a number of activities from the permit requirement for both activities. In addition, the municipality can make other activities not subject to the environmental permit requirement in the environmental plan.
